1. Acceptance of Terms

Welcome to MindFlow by Human-Centric ("MindFlow", "we", "our" or "the Platform"). These Terms and Conditions ("Terms") govern your access and use of our emotional wellness platform based on artificial intelligence.

By registering, accessing, or using MindFlow, you agree to be legally bound by these Terms. If you do not agree, do not use our services.

2. Service Description

MindFlow is an emotional support platform that uses artificial intelligence (AI) to:

  • Provide empathetic and personalized responses to your messages
  • Detect and analyze emotional patterns
  • Offer insights about your emotional well-being
  • Suggest micro-actions to improve your mental health
  • Generate visualizations of your emotional progress

IMPORTANT: MindFlow is NOT a substitute for professional therapy, medical diagnosis, or psychological treatment. AI does not replace the care of mental health professionals. If you experience a crisis or suicidal thoughts, immediately contact emergency services or local crisis lines.

3. Eligibility

To use MindFlow you must:

  • Be at least 18 years old
  • Provide truthful and up-to-date information during registration
  • Have legal capacity to accept these Terms
  • Not be prohibited from using the service under applicable laws

We reserve the right to deny service to anyone, at any time, for any reason.

4. User Account

4.1 Registration

To use MindFlow you must create an account by providing:

  • Full name
  • Valid email address
  • WhatsApp number
  • Secure password

4.2 Verification

You must verify your WhatsApp number using a 4-digit code. Without verification, you will not be able to access the platform.

4.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities performed from your account
  • Notifying us immediately of any unauthorized use

4.4 Suspension and Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • You provide false information
  • You engage in fraudulent or illegal activities
  • You attempt to compromise platform security
  • We determine it necessary to protect our services or users

5. Acceptable Use

5.1 User Commitments

By using MindFlow, you commit to:

  • Using the service only for personal and legal purposes
  • Not sharing your account with third parties
  • Providing truthful information
  • Respecting others' privacy
  • Complying with all applicable laws

5.2 Prohibited Conduct

It is strictly prohibited to:

  • Use the platform for illegal activities
  • Attempt to circumvent security measures
  • Reverse engineer the software
  • Extract data through scraping or automation
  • Send spam or malicious content
  • Impersonate another person
  • Share offensive, violent, or illegal content
  • Interfere with platform operation

6. Intellectual Property

6.1 MindFlow Ownership

All intellectual property rights over MindFlow (including design, code, brand, logos, content) belong to Human-Centric. They are protected by copyright, trademark, and other applicable laws.

6.2 Use License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use MindFlow in accordance with these Terms. You may not:

  • Copy, modify, or create derivative works
  • Sell, license, or distribute the platform
  • Remove copyright or trademark notices

6.3 Your Content

You retain all rights to the messages you share on MindFlow. However, you grant us a worldwide, royalty-free license to:

  • Process your messages to provide the service
  • Generate responses and emotional analysis
  • Improve our algorithms (using aggregated and anonymized data)

7. Use of Artificial Intelligence

MindFlow uses OpenAI GPT and other AI technologies. By using the platform, you acknowledge and accept that:

  • Responses are generated by AI and may contain errors
  • AI is not perfect and may misinterpret contexts
  • Your messages are processed by third-party services (OpenAI)
  • Responses do not constitute professional medical or therapeutic advice
  • Emotion detection is automatic and may be inaccurate

AI Limitation: Artificial intelligence is a support tool, not a mental health professional. For diagnoses, treatments, or emergencies, always consult a qualified professional.

8. Plans, Pricing and Subscriptions

8.1 Available Plans

MindFlow offers two plans:

  • Basic Plan: Completely free, no credit card required. Includes 20 messages per month and all basic features.
  • Premium Plan: Monthly recurring subscription of $12 USD per month. Includes 60 messages per month, priority support, and more detailed progress visualization.

8.2 Premium Subscription - Important Information

BEFORE SUBSCRIBING TO PREMIUM, YOU MUST KNOW:

  • Premium is a monthly recurring subscription that automatically renews each month.
  • You will be charged $12 USD each month on the same date you subscribed.
  • The first charge occurs when you upgrade to Premium.
  • The subscription continues until you explicitly cancel it.

8.3 Payment Methods

We accept payments via credit and debit cards through Stripe, our secure payment processor. We accept all major cards (Visa, Mastercard, American Express, etc.).

The Basic plan does not require a payment method. You only need to register with your email and phone.

8.4 Recurring Billing

By subscribing to Premium, you agree that:

  • You will be automatically charged $12 USD each month
  • Billing occurs on the same date each month (e.g., if you subscribe on the 15th, you will be charged on the 15th of each month)
  • You will receive a receipt by email after each charge
  • If your payment method fails, you will receive notifications to update it

8.5 Premium Subscription Cancellation

You can cancel your Premium subscription at any time:

IMPORTANT ABOUT CANCELLATION:

  • Your subscription cancels at the end of the period you already paid for
  • You will not lose access immediately - you will continue to have Premium until the end of the period
  • No further charges will be made after cancellation
  • There are no penalties or cancellation fees
  • You can reactivate your subscription at any time

8.6 Refunds

No refunds are issued for partial periods. However, when you cancel your Premium subscription, you will continue to have access until the end of the period you already paid for. No further charges will be made after cancellation.

8.7 Price Changes

We reserve the right to modify the prices of our plans. If we increase the price of Premium:

  • We will notify you at least 30 days in advance by email
  • The new price will apply on your next renewal
  • You can cancel before renewal if you do not agree with the new price

8.8 Usage Limits

Each plan has message limits:

  • Basic Plan: 20 messages per month. Messages renew each month and do not accumulate.
  • Premium Plan: 60 messages per month. Messages renew each month and do not accumulate.

If you reach your monthly limit, you will have to wait until the next month or upgrade to Premium (if you are on Basic) to get more messages.

8.9 Plan Upgrade and Downgrade

You can upgrade from Basic to Premium at any time from your subscription page. If you cancel Premium, you will automatically return to the free Basic plan at the end of the paid period. Your progress and data are maintained in both cases.

9. Privacy and Data Protection

Your privacy is important to us. The processing of your personal data is governed by our Privacy Notice.

By accepting these Terms, you also accept our Privacy Notice.

10. Garantías y Descargos

10.1 Servicio "TAL CUAL"

MindFlow se proporciona "TAL CUAL" y "SEGÚN DISPONIBILIDAD", sin garantías de ningún tipo, expresas o implícitas, incluyendo:

  • Disponibilidad ininterrumpida o libre de errores
  • Precisión absoluta de las respuestas de IA
  • Resultados específicos en tu bienestar emocional
  • Compatibilidad con todos los dispositivos

10.2 No es Consejo Médico

MindFlow NO proporciona consejo médico, diagnósticos o tratamientos. No somos profesionales de la salud mental. Las respuestas son generadas por IA para fines informativos y de apoyo emocional general únicamente.

10.3 Emergencias

Si experimentas una emergencia de salud mental o pensamientos suicidas:

  • México: Llama al 911 o a la Línea de la Vida: 800-911-2000
  • Internacional: Contacta servicios de emergencia locales
  • Acude al hospital o centro de salud más cercano

11. Limitation of Liability

To the maximum extent permitted by law, Human-Centric and MindFlow will NOT be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of data, income, or benefits
  • Emotional or psychological damages
  • Actions based on AI responses
  • Service interruptions
  • Errors in emotion detection
  • Misuse by third parties

Our maximum liability will not exceed the amount paid by you (if applicable) in the last 12 months.

12. Indemnification

You agree to indemnify and hold harmless Human-Centric, its directors, employees, and affiliates from any claim, loss, liability, damage, or expense (including legal fees) arising from:

  • Your violation of these Terms
  • Your misuse of the service
  • Violation of third-party rights
  • Any content you post

13. Service and Terms Modifications

We reserve the right to:

  • Modify, suspend, or discontinue MindFlow at any time
  • Update these Terms occasionally
  • Change features or characteristics

We will notify you of material changes by email or through a notice on the platform. Continued use after changes constitutes your acceptance.

14. Dispute Resolution

14.1 Applicable Law

These Terms are governed by the laws of Mexico, without regard to conflict of law provisions.

14.2 Jurisdiction

Any dispute related to these Terms will be resolved in the competent courts of Mexico.

14.3 Informal Resolution

Before initiating any legal proceeding, contact: legal@human-zen.com to attempt to resolve the dispute informally.

15. General Provisions

15.1 Complete Agreement

These Terms, together with our Privacy Notice, constitute the complete agreement between you and MindFlow.

15.2 Severability

If any provision is deemed invalid, the others will remain in effect.

15.3 Assignment

You may not transfer your rights under these Terms without our prior written consent.

15.4 Waiver

No waiver of these Terms will be valid unless in writing and signed by us.

15.5 Language

These Terms are written in Spanish. Any translation is for reference only.

  • You accept that your messages will be processed by OpenAI
  • You will use the service responsibly and legally
